LegacySure – Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by LegacySure (“we”, “us”, “our”). By applying for, purchasing, or using any LegacySure product or service, you agree to be bound by these Terms.

1. Services Offered

LegacySure provides funeral plans and related financial protection products. All services are subject to eligibility criteria, underwriting requirements, and acceptance by the relevant insurer or underwriter.

2. Eligibility

To use our services, you must:

  • Be at least 18 years of age, or have legal capacity to contract

  • Provide accurate, complete, and truthful information

  • Comply with all applicable South African laws and regulations

LegacySure reserves the right to decline applications that do not meet eligibility or compliance requirements.

3. Policy Commencement and Coverage

  • Coverage begins only once an application has been approved and the first premium has been successfully received.

  • Policy terms, benefits, exclusions, and waiting periods will be outlined in your policy schedule or policy document.

  • No cover is provided until written confirmation is issued.

4. Premiums and Payments

  • Premiums are payable monthly or as agreed in your policy schedule.

  • Failure to pay premiums may result in suspension or termination of cover.

  • Premium amounts may change in accordance with policy terms, subject to reasonable notice.

5. Client Responsibilities

You agree to:

  • Provide truthful and complete information at all times

  • Notify LegacySure of any changes to personal or beneficiary details

  • Pay premiums on time

  • Read and understand policy documentation provided

Failure to meet these responsibilities may result in claim rejection or policy cancellation.

6. Cancellations and Refunds

  • Cancellations and refunds are governed by the LegacySure Return and Refund Policy.

  • Cooling-off periods and refund eligibility apply as outlined in that policy.

7. Claims

  • Claims must be submitted in accordance with the procedures and documentation requirements communicated by LegacySure.

  • Claims are subject to verification and policy terms, including waiting periods and exclusions.

  • Submission of fraudulent or misleading claims may result in claim rejection and policy termination.

8. Policy Amendments

LegacySure reserves the right to amend policy terms, premiums, or benefits where permitted by law. Clients will be notified of any material changes in advance.

9. Limitation of Liability

To the extent permitted by law:

  • LegacySure shall not be liable for losses arising from inaccurate information provided by the client

  • We are not responsible for delays caused by third parties, service providers, or events beyond our control

  • Our liability is limited to the benefits payable under the applicable policy

10. Intellectual Property

All content, branding, trademarks, and materials used by LegacySure remain the intellectual property of LegacySure and may not be used without prior written consent.

11. Privacy and Data Protection

Your personal information is processed in accordance with the LegacySure Privacy Policy and applicable data protection laws, including POPIA.

12. Termination of Services

LegacySure may suspend or terminate services where:

  • Premiums are unpaid

  • Fraud, misrepresentation, or policy abuse is detected

  • Legal or regulatory requirements necessitate termination

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of South African courts.

14. Complaints and Dispute Resolution

Clients are encouraged to first raise concerns directly with LegacySure. If a matter remains unresolved, it may be escalated to the appropriate regulatory or dispute resolution body.
